Herbalife Scam? Yes It Is In My Opinion.
Update July 15, 2016: Herbalife is going to have to start operating legitimately, making only truthful claims about how much money its members are likely to make, and it will have to compensate consumers for the losses they have suffered as a result of what we charge are unfair and deceptive practices. – Source FTC Chairwoman Edith Ramirez
In this post and video, I walk you through the reasons why Herbalife is a scam and a pyramid scheme.

Top 1% of Herbalife distributors make over $6000
Must Recruit to reach this 1%
You can get a 25% discount by becoming a distributor, but you can get the same product for a 35% discount online without paying for a membership.
There is no point for anyone to join Herbalife for a product discount.
70% Rule: Must Sell 70% of your products to others.
It costs almost $3000 to become a sales leader.

Anyone considering an active distributorship needs to understand the realities of direct selling. It is hard work. There is no shortcut to riches, no guarantee of success.
The Herbalife scam is a product-based Pyramid Scheme.
One sign of a pyramid scheme is if distributors sell more product to other distributors than to the public — or if they make more money from recruiting than they do from selling. – Federal Trade Commission (FTC) Info on Multi-Level Marketing: http://www.ftc.gov/bcp/edu/pubs/consumer/invest/inv08.shtm
In 2011 Herbalife was ruled by a Belgian court to be a pyramid scheme:
The judgment of the court is that distributors in the sales network of Herbalife can get more profits out of the indirect profit payments, Royalty Overrides, and production bonuses which are calculated over the sale of products by those under them in the network than by the profits out of the direct sale of products to the consumer.
The consumer is in a way forced to become an independent distributor to then purchase the goods in the context of his enterprise and ‘use’ the goods as a consumer.
The “supervisors” apparently seek to expand the hierarchical network, by recruiting lower placed salespeople to realize profit from products purchased by these salespeople, rather than to drive sales to end-consumers.
Herbalife is getting the biggest part of her profit out of the distributors who don´t make a high monthly turnover and who most likely resign after less than a year.
Herbalife cannot even answer the question by the court as to how many of its products are eventually sold to an end-consumer.
http://www.scribd.com/doc/76678476/Herbalife-Belgian-Court-Decision
Herbalife has now won a dismissal of this case against them.
“The fact that the earned remuneration is based on sales of products by other participants in the network, namely ‘downline’ distributors, does not constitute a violation” of the consumer protection and market practices law at issue, the appeals court said in its Dec. 2 ruling.
I do not agree that this dismissal means that the Herbalife scam is not a Pyramid Scheme. The vast majority of sales to downline distributors are exactly what makes Herbalife a product-based pyramid scheme. What these companies do is hide payments into the pyramid with product sales to downline distributors and not to customers. This court and the FTC are allowing the Herbalife scam to continue. It is time for reform to come to this industry.
OMG.. my sister-in-law was selling Herbalife eons ago. I was married and had been working as a legal secretary.. but was growing very tired of the inequity in our legal system.. so I had to exit that profession.
I signed up under my sister-in-law to sell Herbalife. It was fun for a while.. and I at least earned enough money to pay for my initial investment.. but after a while I could see that it was probably not going to provide me with enough money to make it worth my while. That was the end of my experience with Herbalife.
The main reason I came to your site was to see if you had anything on a company called Team National. I don’t know how the FTC has not put an end to this business yet.
Some friends of mine joined this company.. and were actually doing very well with it. They tried to get me involved.. but 1) I love what I am doing.. and 2) MLM is really not my thing.. been there done that.
They gave me a video to watch and I could see right away that it was an obvious pyramid scheme. People make money by getting other people to sign up. Over the years they added a few products to sell.. but no one is making money from the sales of a few low priced items.. the money is being made in signing up other distributors.
The people running the company are obviously very clever and have done everything possible to make sure they are not seen as a pyramid scheme. They have even managed to give themselves additional credibility in becoming a respected member of the Direct Selling Association.
My friends were so impressed with the fact that the company has “alliances” with companies such as Macy’s and WalMart. When I took a look at what they were referring to.. I discovered these were nothing more than affiliate programs which anyone can join. They, of course, had no idea what I was talking about as they are not familiar with online marketing or affiliate programs.
Nevertheless.. I think you should take a look at this company so your readers can be aware.
If you need a copy of their video to learn more about these people.. I will gladly send you one. A lot of people are making a lot of money with this program.. but a lot of others are investing $2500 and not making a dime.

Herballife – I get that you are calling a Scam but my question is do the products work?
loading...
Thank you for this. I was involved with Herbalife from 2002 to 2003. They are definitely a scam. I don’t remember how much money I lost, but it is at least $1,800 (I partnered with another woman to buy into the “supervisor” level. Ha Ha. I never supervised anybody). The lies and deceit come straight from the top. It operates just like a cult. They convince you to not spend time with anyone who raises doubts about the company. Those people are called “dream stealers.” I almost lost friendships, which are priceless, to this scam.

So I was working and this guy felt sorry after I told him how miserable my day was… Out of nowhere he asked if I was serious about changing my life.. I told him yeah thinking it was my great personality that influenced me into him taking me on board to make millions in his unknown company..next thing you know he throws down a herbalife (whatajokeherbalifeis) card and said he’d give me a call..thankfully I did some research to find out what others thought about herbalife (not even worthy of getting the h capitalized) only to find out everyone hates it for various reasons. So the guy texts me and asks if I’d like to meet him but i told him “I respectively decline” he comes back at me hard to get me to meet with him. Long story short- anyone willing to breach your choices to try and manipulate you into allowing them to sit down needs to be put in prison for having no care for others but there own gain.. herbalife dude came around acting all polite and professional (way to much that even a child wouldn’t be able to trust him). I’m greatful for you for making this website..hopefully others will stumble upon it.

How about DUB nutrition….They have been around 8 yrs or so and there is not 1 negative comment about them anywhere…….I got out of it after 2 months, the MLM BIZ is not for me. But doesnt mean this company isnt good. Thanks

Never heard of them. I will add them to my list to look into.

Ethan,
I would love for Herbalife to be shut down. I know they were under investigations a few years ago. Do you know what came of it? Or what could the public do to shut it down? Far-fetched, but this company needs to be shut down.
loading...
I agree. They need to be shutdown. They are currently still under investigation.

what about Jeunesse

I have not had a chance to review them. I will add them to my list to review.

Have you reviewed Advocare?
loading...
They are on my list to review.

What about advocare

Thank you for the suggestion. They are on my list to review.

Very informative site as well, but you are basically putting every MLM in the scam category? Not that they may not be but could you tell me which MLM companies you don’t see as scam, there has to be some…no? While I’m at it, could you do yet another review on SendOutCards as well?
Thanks 🙂
loading...
I recommend you avoid MLM.
loading...
Ethan, I would recommend you look into advocare. It’s not a scam.
loading...
Then why would you want me to look into it? I only report on scams.
loading...
Just giving my 2 cents. I have thoroughly enjoyed and been pretty successful in the past with Mary Kay. Like Ethan stated in his review above, direct selling is HARD WORK.
loading...
your statement makes it obvious that you have no idea how MLM’s work. You only make money if you are on the very top of the pyramid. It works for a dozen or so people and after that no one makes any money. All the money is going to the company.

Hi Ethan, I am wondering if you could do a review on NuSkin as well?

Nu Skin is on my list to review. Thank you for the suggestion.

Ethan, I was with Beachbody for a little while before I realized what I’d gotten myself into. I definitely don’t see it as bad of a deal as HL, Plexus, or WUN, but I would like to hear your take on it. The reason I went against my better judgment and went w/ BB MLM was that I genuinely loved (still love) their products. Their workout videos and clean-eating philosophy work for my lifestyle. My “coach” talked me into becoming a coach (distributor) because I was so gung-ho about my own success with their products. They also sell on QVC and paid programming as well as Amazon. The only thing I wonder about is Shakeology, which is a fabulous shake. I question its position in the MLM strategy. I’d like to hear your opinion on Beachbody and if you’d consider them a scam. I dropped my “coaching” membership a few months ago, so be as brutally honest as you always are! 😉 Thanks!

Glad to have discovered your site here, Ethan. I’m in the health & fitness industry so everywhere I turn I see people shouting about Herbalife (among other totally-not-MLM businesses).
It’s a bit odd to see the fierce devotion some distributors have. It’s creepy – I’ve never met a small business owner who bragged so much about how much they made / how much they love their life.
As well, as someone who tries to help clear up the B.S. rife in my industry, I really appreciate seeing someone else trying to help others protect themselves. Awesome work.

Hi, what about kyani and organo gold? Good information, thank you. Greetings from México.

I have not reviewed these yet, but here is a review for Gano Excel which is like Organo Gold. http://ethanvanderbuilt.com/2013/05/17/gano-excel-is-a-scam-yes-it-is-in-my-opinion/

Ethan,
Great info Ethan, would love to hear more about Isagenix, a similar company to Herbalife 🙂

Hi Ethan,
You’re doing a great job re these videos. I lost a loved one to MLM scam artists now he is unable to talk to anyone without trying to recruit them and his only conversation in canned MLM-cult speak. He is an intelligent man but since being brainwashed he is unable to follow logic. He is in a lot of debt and denial.
There are a lot of interesting posts on the Married to an Ambot blog if you look that up. It is about Amway another MLM cult but similar stories, similar devastation to finances, family and friendship. Even if you could get rich that way (hardly any chance) is it really worth the trail of destruction?

Thank you Ros. It is sad the human toll that these scams take on peoples lives and relationships.
